BORDEAUX, France (Reuters) -- A French court annulled France's first gay marriage on Tuesday, setting a legal precedent outlawing same-sex marriages.



"The tribunal declared null and void the marriage between Mr. Stephane Chapin and Mr. Bertrand Charpentier," the court in the southwestern city of Bordeaux said in its ruling.



The government had opposed the marriage on June 5 in the town hall of Begles, a suburb of Bordeaux, and suspended local Mayor Noele Mamere who conducted the ceremony.



The decision is sure to upset gay rights activists who had hailed the marriage as a victory for tolerance. Conservatives had said the wedding was an attack on the sanctity of marriage.



French law allows civil unions between homosexuals but gays say this puts them at a disadvantage in terms of tax, inheritance and adoption rights.

Bingo.

There are ways around the money issue...if that's really the only reason a gay would want to get married. But as far as adoption goes, GOOD! I don't think gays should be allowed to adopt. It's not fair to the child, nor the future progeny of said child.

Donald Henneberger, formerly Donald Smith, recently received a letter from the National Passport Center in Portsmouth, New Hampshire, denying his request for a name change on his passport. The center said it would not recognize a marriage license for a same-sex couple as proof of a name change.



The center addressed the letter to "Mr. Henneberger."



Henneberger married his partner Arthur Henneberger in May, when same-sex marriages became legal in the Bay State. On the marriage license, the couple checked a box that automatically changes the last names of the partners to whatever they request.



The letter from the National Passport Center cites the federal Defense of Marriage Act, which states a marriage can only be between a man and a woman, and a spouse can only refer to a person of the opposite sex.



Donald Henneberger said he had no trouble with the Social Security Administration, another federal agency, when he requested a card in his new name.



He and his partner now have gone to Probate Court to get further proof of Henneberger's name change.



"The woman at Probate Court said, 'What do you want to do -- change your name to Henneberger? It's already Henneberger,"' Donald Henneberger said.



Rep. Richard Neal's office advised the Hennebergers to return to court, and this time the court would initiate the name change. The couple had sought the Democratic congressman's help.



"You have to publicize your intent, demonstrate that you are not changing your name for fraudulent purposes and then you have to appear before a judge," said Jennifer Levi, a professor at Western New England School of Law. She said the Probate Court name-change process is cumbersome.



Henneberger balks at spending $180 in court fees and waiting for the eight-week process to run its course.



"It's discriminatory," he said.

...in the same way it's discriminatory that men are not allowed in the ladies restroom. Gimme a break. :rolleyes



There is, after all, a need to be discriminating on certain issues...but they'll try and find a way to legitimatize what they have done in any way they can...including playing the "it's discriminatory" card. After all, what difference does a name change have anyhow? None, really. So why push the issue unless the is an alterior motive?

I don't know....



Most recent (7/27) poll of 21 states show Bush ahead in 13 of them. Since we elect through the electorial college here, it does not really matter as much what the general public thinks. It is possible for a person to win even if the majority of the public do not vote for him. Strange but true.



I think it's too close to call, yet.

Hmmmmm.... I missed to read the original and I therefore do not know what your main problem now is/was.



Why is the board here "one-sided"?



At least me I do not like to fight the battles here all alone against the neo-cons :)



On the other hand, the topic here is (oh wow) NOT about Bush. It's about same sex-marriage and while I have nothing against gays I strongly oppose same-sex marriage. Same sex mariage does not fit into my worldview. I believe in family, children and cultural values. Same sex marriage is not compatible with my listed set of values. This does not make me a evil person like gays are not evil persons by definition.
